Mail Box Policies

Mailboxes are an accepted use within a right of way, therefore if a plows comes into contact with a mailbox it will replaced by the town if asked. A mailbox damaged due to snow removal without visible contact of the plow or wing is not replaced. This becomes an act of mother nature.
With respect to fences, walls or other "structures" the RSA's clearly provide for protection in that any "structure" within the right of way is clearly considered a nuisance. Case law adds that the selectmen cannot allow this type of "structure" to be law also and the selectmen cannot allow this type of "structure" to be placed as this would constitute an unauthorized discontinuance, something only town meeting can approve. Selectmen have instituted a policy to determine the right of way, in places where it is not easily identifiable.
Henniker
The town of Henniker will no longer be responsible for damages to, but not limited to, mailboxes, fences, stonewalls, lawns, driveways, or any other object placed within the right-of-way of any town road or street. It is the responsibility of the owner of such property to replace or repair anything within a town right of way that has been damaged as a result of town road maintenance.
